Washington Cannabis Advertising Laws & Marketing Rules (2026)

Washington writes some of the most detailed cannabis sign and advertising rules in the country, down to the square inch. A sign that is one size too big, or a coupon priced one dollar too low, can become a violation.

This guide to Washington cannabis advertising laws is for dispensary owners, operators, marketing managers, and brand teams. It explains what the Liquor and Cannabis Board (LCB) allows, what changed on January 1, 2026, and how to keep campaigns compliant.

This page is general information, not legal advice. Rules change often, so confirm with your compliance officer and licensed cannabis counsel before launching a campaign. For a broader market view, visit our Washington cannabis marketing hub.

The core challenge is that Washington limits where and how you can be seen. The answer is a compliance-first mix of owned media, precise geo-targeting, and signage built to spec.

01

Is Marijuana Legal in Washington? (2026 Status)

Yes. Washington voters approved Initiative 502 in 2012, and the first licensed retail stores opened on July 8, 2014. Adults 21 and older may buy from licensed cannabis retailers.

In 2015, Senate Bill 5052 merged the unregulated medical market into the licensed recreational system, according to the LCB. Today, retailers with a medical endorsement can serve qualifying patients and designated providers. There is no separate medical dispensary network.

The Washington State Liquor and Cannabis Board licenses and regulates the industry. The main advertising statute is RCW 69.50.369. The LCB’s rule is WAC 314-55-155.

Federal and hemp status check

Marijuana remains federally illegal for adult use. In April 2026, the Department of Justice moved state-licensed medical marijuana to Schedule III, per law firm summaries of the final order. A broader rescheduling hearing was paused in late September 2026.

On hemp, the LCB says only licensed cannabis retailers may sell products with any detectable THC. That includes hemp-derived and synthetic forms like delta-8. Separately, a federal hemp redefinition is set to take effect December 11, 2026.

Who Regulates Cannabis Advertising in Washington

The LCB enforces the advertising statute and its own rules for licensed producers, processors, researchers, and retailers. Cities, towns, and counties may adopt stricter outdoor advertising rules and enforce them locally.

The rules changed recently. Engrossed Senate Bill 5206, Chapter 378 of the Laws of 2025, took effect January 1, 2026. It raised the number of exterior retail signs from two to four. The LCB updated WAC 314-55-155 to match, effective July 4, 2026.

Enforcement is usually triggered by inspections, complaints, and visible problems like oversized signs. Washington dispensary advertising regulations are easy to check from the street, so assume someone will.

Content Rules: What Washington Ads Can and Cannot Say

Under WAC 314-55-155, advertising may not be false or misleading or promote overconsumption. It may not portray alcohol, tobacco, nicotine, or driving. It also may not claim curative or therapeutic effects.

Youth protections are strict. Ads may not depict minors consuming cannabis or use content especially appealing to children. The statute bars toys, inflatables, and cartoon or movie characters. It also bars commercial mascots outside or near a licensed business.

Required warnings

Except for outdoor advertising, every ad must include four warnings. The type must be at least 10 percent of the largest type in the ad. The warnings are:

Pricing, coupons, and giveaways

Retailers may not sell or advertise cannabis below acquisition cost, except for medical sales to qualifying patients. Coupons cannot push the price below that cost either.

Giveaways and branded or unbranded merchandise are generally banned. A narrow exception covers incidental items, such as matches, worth less than one dollar and not advertised outside the store.

05

Placement and Audience Rules

The 1,000-foot buffer

No licensee may place or maintain cannabis advertising within 1,000 feet of the perimeter of the protected sites listed above. The LCB rule notes an exception where a local ordinance reduces that distance. Map every placement before you buy it.

Retail signs, trade name signs, and billboards

Retailers may display up to four signs on the main-entrance side of the building, each 1,600 square inches or less. Signs must be affixed to the building or hung in its windows. Signs under 512 square inches with only basic information, such as hours or “welcome,” are not treated as advertising.

Licensees may also use up to two trade name signs, subject to local size rules. Trade name signs show only the business trade name, not product brands.

Outdoor signs, including billboards, are limited to text identifying the retail outlet. That means business name, location, and type of business. They may not depict cannabis plants, products, or images likely to appeal to children.

Billboards visible from roads, rights-of-way, or public parking areas are generally banned. The exception lets a licensed retailer use a billboard or outdoor sign only to identify the business, its nature, and directions to it. Inside signs clearly visible from outside must meet outdoor sign rules.

Transit, venues, and events

Transit advertising is prohibited, including on vehicles and at stops, stations, taxi stands, and airports. Outdoor cannabis advertising is also banned at arenas, stadiums, shopping malls, fairs, farmers markets, and video game arcades. Areas the LCB classifies as age-restricted are the exception.

So a sign at Lumen Field is off the table unless it sits in an approved adult-only area. Temporary event signs at adult-only venues may go up no more than 14 days before the event.

Washington Cannabis Digital Marketing

Washington cannabis digital marketing is where most growth happens, because outdoor options are tight. The same content rules, warnings, and 21+ statements apply to digital ads. Plan every banner and landing page around them.

Dispensary SEO in Washington is the strongest owned channel. Well-structured local pages, accurate menus, and educational content earn traffic without paid placement. Keep product copy free of therapeutic claims.

Washington cannabis website advertising rules are mostly content rules. WAC 314-55-155 does not spell out an age gate, but a 21+ gate is a sensible control. It also supports the required age statement.

The out-of-state ban is the big programmatic issue. Marketing aimed at people living outside Washington is prohibited. Keep geo-fences inside state lines, especially near Oregon and Idaho borders.

Google Ads and Meta both restrict cannabis advertising under their own policies. Most dispensaries rely on SEO, programmatic display through cannabis-friendly DSPs, email, and SMS. For SMS, federal TCPA consent rules apply on top of state rules, and carriers commonly filter cannabis content.

07

Penalties and Enforcement

RCW 69.50.369 directs the LCB to adopt penalty rules. Until it does, the statute sets a fine of $1,000 for each violation. The penalty rules must escalate, up to suspension or revocation for repeat violations.

Local governments that adopt stricter outdoor advertising rules enforce those rules themselves. A sign can therefore pass state review and still fail a city code. Keep records of sign sizes, placement maps, and creative approvals for every campaign.

Communities

Marketing in Seattle, Spokane, Tacoma, Vancouver, and Bellevue

State rules apply in every city, but local sign codes and zoning vary. Check with each municipality before you print, mount, or buy outdoor media.

Visitors heading to Mount Rainier National Park also search along the way. Organic local listings capture that traffic without any outdoor placement risk.

Seattle

Tourist traffic around Pike Place Market and the Space Needle drives near-me searches. Seattle dispensary SEO and cannabis advertising in Seattle, WA should capture that intent while respecting the 1,000-foot buffers.

Spokane

Spokane sits close to Idaho, so the out-of-state targeting ban matters. Spokane dispensary SEO and cannabis advertising in Spokane, WA should stay focused on Washington audiences.

Tacoma

Tacoma dispensary SEO and cannabis advertising in Tacoma, WA benefit from neighborhood pages and tight geo-fencing away from protected sites.

Vancouver

Vancouver borders Portland, Oregon. Vancouver dispensary SEO works, but cannabis advertising in Vancouver, WA cannot be aimed at Oregon residents.

Bellevue

Bellevue dispensary SEO and cannabis advertising in Bellevue, WA should account for dense retail corridors and local sign rules.

FAQ

Washington Cannabis Advertising FAQ

Yes, within tight limits. Licensed retailers can advertise if ads avoid 1,000-foot buffers, transit, youth appeal, and out-of-state targeting. Most ads need a 21+ statement and four required warnings. Outdoor signs and billboards are text only and limited to the business name, location, and type of business.

Yes. Voters approved Initiative 502 in 2012, and licensed retail sales began July 8, 2014. Adults 21 and older can buy from licensed cannabis retailers. The LCB regulates the market, and medical patients are served through retailers that hold a medical endorsement rather than separate medical dispensaries.

Medical patients are served inside the licensed retail system, so the same advertising rules apply. One difference is pricing. The ban on selling below acquisition cost has an exception for medical sales to qualifying patients. Retailers with a medical endorsement may also donate products only to qualifying patients or designated providers.

Only in a narrow way. Billboards visible from roads or public parking areas are generally banned. A licensed retailer may use a billboard only to identify the business, its nature, and directions to it. The text cannot depict cannabis or appeal to children, and local governments can add stricter rules.

Websites follow the same content rules as other ads. Avoid therapeutic claims, overconsumption messages, youth appeal, and alcohol or driving imagery. Include the 21+ statement and required warnings in advertising content. An age gate is not spelled out in the main rule, but it is a sensible control.

No. Washington prohibits marketing aimed at people living outside the state. A Vancouver dispensary can rank in search and run ads geo-fenced inside Washington. It should not build campaigns or targeting that aim at Oregon residents, even though many cross the river to shop.
