South Dakota Cannabis Advertising Laws & Marketing Rules (2026)

South Dakota bans more advertising channels for medical cannabis than most operators expect. Billboards, radio, TV, and most print are off the table, and every ad needs a required disclaimer and license number.

Cannabis Marketing Channels You Can Use in South Dakota

This guide breaks down South Dakota cannabis advertising laws for dispensary owners, medical cannabis establishment operators, marketing managers, and hemp brand marketers. It covers what you may say, where you may say it, and who you may target. This page is general information, not legal advice. Rules change often, so confirm with your compliance officer and licensed cannabis counsel before launching a campaign.

South Dakota does not have a dedicated Seedless Media state hub yet. For the full service picture, see our dispensary marketing services and use this page for the state rules.

01

Is Marijuana Legal in South Dakota? (2026 Status)

Medical cannabis is legal in South Dakota. Adult-use cannabis is not. Voters approved Initiated Measure 26 in November 2020, and it took effect July 1, 2021 as SDCL chapter 34-20G.

Recreational legalization has a rough history in the state, according to Ballotpedia (a secondary source). Voters passed Amendment A in 2020, but courts struck it down. They rejected Initiated Measure 27 in 2022 and Initiated Measure 29 in 2024, the latter with about 55.5 percent voting no.

The South Dakota Department of Health (DOH) runs the program and writes its rules in ARSD article 44:90. The advertising rules sit in ARSD chapter 44:90:10.

Federal status changed in 2026. A federal order effective April 28, 2026 placed marijuana covered by a state medical marijuana license in Schedule III (Federal Register). All other marijuana remains Schedule I. As explained below, that change creates an open question for South Dakota’s channel bans.

South Dakota Cannabis Advertising Laws at a Glance

Here are the South Dakota dispensary advertising regulations that matter most for planning:

03

Who Regulates Cannabis Marketing in South Dakota

DOH is the regulator. The statute directs it to adopt rules restricting the advertising, signage, and display of medical cannabis. The same section, SDCL 34-20G-72, limits how far those rules can go.

Under that statute, the rules may not prevent appropriate signs on dispensary property. They also may not block business directory listings, listings in marijuana-related or medical publications, or sponsorship of health or nonprofit charity or advocacy events.

Enforcement often starts with a notice. Under ARSD 44:90:10:19, nonconforming advertising violates the rules. After DOH gives notice, you must stop the ad and remove it from websites, social media, apps, and signs. Failing to do that within 48 hours is a serious and knowing violation.

04

Content Rules: What Ads Can and Cannot Say

South Dakota cannabis marketing regulations spell out banned content in detail. Under ARSD 44:90:10:17, an establishment’s ads may not contain:

Youth appeal is restricted twice. The targeting rule bars ads that depict minors or use cartoons, toys, or youth-oriented imagery. Separate labeling rules bar imagery likely to appeal to anyone under 21, including cartoon characters, animals, and emoji.

Every ad also needs the required statement, “For medical use by qualifying patients only.” It must also show your medical cannabis establishment identification number.

05

Placement and Audience Rules

The placement rules in ARSD 44:90:10:14.01 cut most mass media. Signs and billboards are banned except on a dispensary’s own premises. Print is banned except publications inside your premises, and broadcast is banned outright.

Audience rules sit in ARSD 44:90:10:15. Ads must be targeted as directly as possible to other establishments, cardholders 21 or older, and readers of medical publications. They may not target non-cardholders, anyone under 21, or practitioners and health care facilities outside medical publications.

Sponsorships need care. The statute protects sponsorship of health or nonprofit charity and advocacy events. The targeting rule, however, bars interacting with the general public at sponsored events in ways aimed at non-cardholders. Plan event presence with counsel.

We did not find a numeric audience-composition threshold or a proximity buffer for ads in these rules. The practical standard is direct targeting of verified adult cardholders.

The Schedule I condition and the 2026 federal change

The channel bans in ARSD 44:90:10:14.01 apply unless and until the DEA removes marijuana from Schedule I. The April 2026 federal order moved only state-licensed medical marijuana to Schedule III. Marijuana in general remains Schedule I.

We have not found any DOH guidance saying the condition has been met. Treat the channel bans as fully in force until DOH or counsel says otherwise. DOH also proposed a broad package of amendments to article 44:90 in August 2026, with a public hearing on September 23, 2026. Watch for changes to chapter 44:90:10.

06

Digital Rules: Websites, SEO, Social, Programmatic, Email and SMS

South Dakota cannabis digital marketing is allowed, but it carries specific controls. The broadcast ban excludes your own website and social media accounts. ARSD 44:90:10:16 then adds rules for websites, social media, and mobile apps.

The South Dakota cannabis website advertising rules require two features for online advertising:

Here is how that plays out across channels:

Google Ads and Meta restrict cannabis ads, so most operators rely on SEO, cannabis-friendly programmatic partners, email, and SMS. In South Dakota, owned channels do the heaviest lifting.

07

Penalties and Enforcement

Under SDCL 34-20G-80, DOH may impose probation, a fine, suspension, or revocation after notice and a hearing. These apply for multiple negligent or knowing violations, or a single serious and knowing violation.

Probation may last up to six months. Suspension may last up to six months, or up to one year for a serious violation of patient health and safety. The statute does not set fine amounts. Ignoring a DOH removal notice for 48 hours counts as a serious and knowing violation, so respond fast.

08

Hemp and Intoxicating Hemp Products

Hemp is a separate track. Secondary reporting describes a 2024 state law, HB 1125, that banned producing or selling intoxicating hemp-derived cannabinoid products starting July 1, 2024. A 2026 bill, SB 39, repeals the state hemp program effective January 1, 2027, and was signed by the governor.

SB 39 also excludes delta-8 THC, delta-10 THC, THC-O, HHC, and THCP products from the industrial hemp product definition. Federal hemp rules are tightening too. Secondary legal sources report most federal changes now take effect December 11, 2026.

For CBD and hemp brands, avoid health claims and confirm every product’s legal status. Our CBD marketing team builds campaigns that fit both state and platform rules.

Communities

Marketing in Sioux Falls, Rapid City, Aberdeen, Brookings and Watertown

Sioux Falls cannabis marketing reaches the state’s largest metro, which sits near the Minnesota and Iowa borders. Geo-target tightly, and never suggest that buyers move product across state lines. That message would violate the interstate transport rule.

Rapid City cannabis marketing faces heavy tourist traffic tied to Mount Rushmore and Badlands National Park. Most visitors are not South Dakota cardholders, and ads may not target non-cardholders. Keep paid targeting focused on verified cardholder lists.

Aberdeen cannabis marketing, Brookings cannabis marketing, and Watertown cannabis marketing serve smaller trade areas. Brookings is a college town, which raises youth-exposure risk. Local zoning and sign rules vary, so check the municipality before planning on-premise signage.

We did not verify any city-specific cannabis advertising ordinance in these five cities. For cannabis advertising Sioux Falls SD, Rapid City SD, Aberdeen SD, Brookings SD, or Watertown SD, the state rules apply first. Sioux Falls dispensary SEO and Rapid City dispensary SEO still depend on accurate local listings and location pages.

How to Market a Dispensary Compliantly in South Dakota

South Dakota dispensary marketing restrictions shift budget from paid reach to owned channels. Here is a compliance-first playbook.

  • Fix your creative system. Add the required statement and establishment ID number to every ad template.
  • Build a compliant site. Our dispensary website development team adds the age verification and opt-out features the rules call for.
  • Win local search. Cannabis dispensary SEO is the strongest form of dispensary SEO South Dakota patients use to find hours, menus, and locations.
  • Grow verified lists. Dispensary email marketing and text message marketing reach confirmed cardholders who opted in.
  • Use paid display carefully. If counsel clears it, our display and geo-targeting ads can target cardholder-matched audiences.

FAQ

FAQ: South Dakota Cannabis Marketing Questions

Medical cannabis is legal, but adult-use cannabis is not. Voters approved the medical program in 2020, and it took effect July 1, 2021 under SDCL chapter 34-20G. Recreational measures failed in 2022 and 2024, and the 2020 Amendment A was struck down by the courts.

Yes, but through limited channels. Dispensaries may use on-premise signs, their own websites and social media accounts, directory listings, and messages to verified cardholders. Billboards, broadcast, handbills, and most print are banned. Every ad must include the required statement and the establishment’s identification number.

Every advertisement must include the statement “For medical use by qualifying patients only.” It must also include the medical cannabis establishment identification number. Put both on websites, social posts, emails, texts, and signs. Build them into templates so no campaign launches without them.

Online advertising must include a verification that the recipient is not an age-restricted cardholder, plus a permanent opt-out feature. In practice, use a 21-plus age gate and a clear unsubscribe option. Content rules still apply, so avoid health claims, candy references, and consumption imagery.

No, under current rules. ARSD 44:90:10:14.01 bans signs and billboards except signs on a dispensary’s own premises. The ban applies unless the DEA removes marijuana from Schedule I. The 2026 federal change was partial, so treat the ban as active until DOH says otherwise.

Your website is a permitted channel, so SEO is allowed. Promotional pages are still advertising, which means content rules, the required statement, and the identification number apply. Educational content should avoid curative or safety claims. An age gate and opt-out features keep the site aligned with the online rules.
