Louisiana Cannabis Advertising Laws & Marketing Rules (2026)

Louisiana rewrote who runs its medical marijuana program, then rewrote its hemp rules, then rewrote both again in 2026 rulemaking. Operators who are still working from 2023 assumptions are marketing against a rulebook that no longer exists.

This guide explains Louisiana cannabis advertising laws for medical marijuana retailers, licensed manufacturers, hemp brands, and the marketers who support them. It covers who regulates what, which advertising limits are on the books, and where the gaps sit.

This page is general information, not legal advice. Rules change often, so confirm with your compliance officer and licensed cannabis counsel before launching a campaign. For a wider look at the state, visit our cannabis marketing in Louisiana hub.

01

Is Marijuana Legal in Louisiana? (2026 Status)

Medical marijuana is legal in Louisiana for patients with a clinician’s recommendation. Adult-use marijuana is not legal. A 2026 bill for an adult-use pilot program, HB 373, died in committee before the session ended on June 1, 2026.

The medical marijuana program

The program operates under La. R.S. 40:1046. Act 693 of 2024 made the Louisiana Department of Health (LDH) the sole regulator, effective January 1, 2025. Retail oversight moved from the Board of Pharmacy to LDH that day, and pharmacy licenses became LDH retail permits.

According to the LDH medical marijuana page, the market has two licensed manufacturers: Good Day Farm Louisiana and Advanced Biomedics (Ilera Holistic Healthcare). Retail is capped at 10 base sites, each allowed up to two satellites. Each permitted retailer must designate a Louisiana-licensed pharmacist.

LDH published its final medical marijuana rule in the January 20, 2026 Louisiana Register. It sits in LAC Title 51, Part XXIX. Act 693 also extended the program’s sunset date to July 1, 2030.

Consumable hemp

Hemp-derived consumable products are legal but tightly limited. Act 752 of 2024 set these rules, effective January 1, 2025:

Federal changes to watch

In April 2026, the DEA moved marijuana held under a state medical license, plus FDA-approved marijuana drugs, to Schedule III. The final rule took effect April 28, 2026. Other marijuana remains Schedule I, and a broader rescheduling hearing was paused in late September 2026.

Congress also narrowed the federal hemp definition in November 2025, capping finished products at 0.4 milligrams of total THC per container. A September 2026 funding law pushed most of those limits to December 11, 2026. Many products legal under Louisiana’s 5-milligram serving cap will not fit the new federal definition.

Louisiana Cannabis Advertising Laws at a Glance

Here are the rules that shape Louisiana cannabis marketing laws and Louisiana dispensary advertising regulations right now:

03

Who Regulates Cannabis Marketing in Louisiana

LDH regulates medical marijuana manufacturers and retailers through its Cannabis Program. It inspects facilities, reviews test results, and issues retail permits. LDH also registers consumable hemp products before they can be sold.

ATC handles hemp retail and wholesale permits and enforces age and sales rules at the counter. Act 752 lets the ATC commissioner adopt rules on on-premise outdoor hemp advertising. The Board of Pharmacy still licenses the pharmacist each retailer must designate.

Enforcement usually starts with an inspection, a complaint, or a product registration review. Marketing that misstates a product’s contents or THC can trigger action on the product, the permit, or both.

Content Rules: What Louisiana Cannabis Ads Can Say

Louisiana medical marijuana laws used to include a strict advertising rule. Before 2023, Board of Pharmacy rules limited marijuana pharmacies to physician-directed marketing and banned public-media ads. The Board repealed that section in October 2023, and LDH’s 2026 rule did not replace it.

That gap does not mean anything goes. Medical marijuana is a regulated medical product, and misleading claims carry real risk. For medical retailers, keep content factual and educational:

For hemp brands, content rules come through product registration and packaging law:

05

Placement, Audience, and Signage Rules

Louisiana has not published a numeric audience-composition threshold for cannabis ads in the sources we reviewed. Build campaigns for adults 21 and older anyway. That matches the hemp sales age and keeps your media plan defensible if rules tighten.

Retail signage is mostly a local question. Parish and city zoning, sign permits, and building codes control exterior signs. LDH’s rule requires certain internal signage, such as a notice that marijuana use in restrooms is prohibited by law.

For hemp, the ATC commissioner can restrict on-premise outdoor advertising. Check current ATC rules before adding window banners or exterior THC promotions.

Event sponsorships need judgment. Venues such as Caesars Superdome and LSU Tiger Stadium draw mixed-age crowds, and many venues set their own cannabis policies. Sponsorships there are hard to square with a 21+ audience standard.

Louisiana Cannabis Digital Marketing

Digital channels carry most of the load for Louisiana operators. SEO, programmatic display, email, and SMS reach patients and adult hemp buyers with far more control than broadcast.

Website. Louisiana cannabis website advertising rules are not spelled out in the LDH rule we reviewed. We still recommend an age gate on every site, clear permit information, and product details that match labels and test results.

SEO. Dispensary SEO in Louisiana should focus on patient education and accurate location pages for base and satellite sites. Our cannabis dispensary SEO team builds content that ranks without medical claims.

Paid search and social. Google Ads and Meta restrict cannabis advertising. Hemp policies vary, so plan for THC creative to be rejected. Plan for organic and programmatic first.

Programmatic. Cannabis-friendly DSPs support tight geo-targeting and 21+ audience filters. Since retailers cannot deliver outside Louisiana, keep geo-fences inside state lines. Our display and geo-targeting ads service sets those controls up front.

Email and SMS. Federal TCPA consent rules apply to texts, and carriers commonly filter cannabis content. Get express written consent and keep messages factual.

Penalties and Enforcement

For medical marijuana, LDH controls the retail permit. Permits renew annually, and losing one ends sales at that site. The exact penalty schedule should be confirmed in LAC 51:XXIX and R.S. 40:1046.

For hemp, Act 752 sets a hard line on repeat violations. A third violation within two years of the first leads to permit revocation and a five-year ineligibility period. LDH can also revoke product registrations when labels or marketing stop complying.

Selling hemp products to anyone under 21 is also addressed in the state criminal code at R.S. 14:93.16. Train every staff member on ID checks.

Marketing in New Orleans, Baton Rouge, Shreveport, Lafayette, and Lake Charles

New Orleans cannabis marketing, Baton Rouge cannabis marketing, and Shreveport cannabis marketing all follow the same state rules. City and parish codes add zoning, sign permits, and business licensing. We did not verify any city-specific cannabis advertising ordinance for these markets, so confirm locally before buying outdoor media.

LDH lists base medical retailers in New Orleans, Baton Rouge, Lafayette, and Lake Charles, plus one in Bossier City in the Shreveport area. Practical notes by market:

For hemp retailers in all five cities, keep creative adult, verify 21+ at checkout, and check ATC rules before outdoor promotion.

New Orleans

New Orleans dispensary SEO competes with heavy tourist traffic around the French Quarter. Patient campaigns work better when tourist-heavy zones are excluded from geo-targeting.

Baton Rouge

Baton Rouge dispensary SEO and cannabis advertising in Baton Rouge LA should account for student audiences near campus. Apply strict 21+ filters.

Shreveport

Shreveport dispensary SEO should cover the Shreveport-Bossier area as one market with clear location pages.

Lafayette

Lafayette dispensary SEO and Lafayette cannabis marketing work best with Acadiana-wide content and local landing pages.

Lake Charles

Lake Charles cannabis marketing and cannabis advertising in Lake Charles LA should keep geo-fences in Louisiana given the Texas border.

How to Market a Dispensary Compliantly in Louisiana

Compliance-first marketing is how Louisiana operators move the needle. Here is a practical playbook:

  • Confirm your lane. Medical marijuana and consumable hemp have different regulators, permits, and content risks.
  • Lead with search. Strong dispensary SEO captures patients searching for retailers and recommendation guidance.
  • Use programmatic carefully. Geo-target inside Louisiana and apply 21+ filters through cannabis-friendly DSPs.
  • Build owned channels. Cannabis email marketing and SMS marketing drive repeat visits with full consent records.
  • Match ads to labels. Every potency or product claim should line up with LDH-approved labels and test results.
  • Watch hemp closely. State registration and the December 2026 federal changes can make product pages outdated fast. Our CBD marketing agency team helps hemp brands shift to compliant lines.
  • Keep a creative log. Record counsel review dates for every campaign.

FAQ

FAQ: Louisiana Dispensary Marketing Restrictions

Only for medical use. Patients need a recommendation from a licensed clinician, and products come from two licensed manufacturers through LDH-permitted retailers. Adult-use marijuana is not legal. An adult-use pilot bill failed in the 2026 session. Hemp-derived consumable products are legal for adults 21 and older within strict THC limits.

Yes, in general. The Board of Pharmacy’s ban on public-media advertising by marijuana pharmacies was repealed in October 2023. LDH’s 2026 rule, as we reviewed it, did not add a new advertising section. Ads must still be truthful, and operators should confirm current requirements with counsel before launching paid media.

Today, very little directly. R.S. 40:1046 and LDH’s LAC 51:XXIX rule focus on licensing, products, labeling, and facilities. General consumer protection law still applies. Avoid health claims, avoid implying state endorsement, and keep marketing consistent with product labels and lab results.

No specific website rule appeared in the LDH medical marijuana rule we reviewed. A smart baseline is an age gate, accurate product and permit details, and no medical claims. Hemp sellers must verify that buyers are 21 or older, so online hemp sales need real age verification at checkout.

Hemp products must be LDH-registered, sold only to adults 21 and older, and capped at 5 milligrams of THC per serving. Packaging cannot be designed to appeal to children. LDH can revoke a registration if marketing stops complying, and the ATC commissioner can restrict on-premise outdoor advertising.

Dispensary SEO in Louisiana centers on patient education, accurate location pages, and strong local signals for each base and satellite site. Explain how recommendations work and where patients can buy. Avoid medical claims. SEO is often the highest-return channel because paid platforms restrict cannabis ads.
