Delaware’s adult-use market is just over a year old, and its advertising rules are highly prescriptive. Required warnings, an 85 percent adult audience test, and a near-total outdoor ban leave little room for guesswork.
This guide covers Delaware cannabis advertising laws for dispensary owners, operators, marketing managers, and brand teams. It explains what the Office of the Marijuana Commissioner requires and how to build compliant reach.
This page is general information, not legal advice. Rules change often, so confirm with your compliance officer and licensed cannabis counsel before launching a campaign. For broader strategy, see our Delaware cannabis marketing page.
Yes. Delaware has adult-use and medical cannabis. Adults 21 and older may buy from licensed retailers, and adult-use sales began August 1, 2025. The state reported 14 retail locations open at launch.
Adult-use cannabis runs under the Delaware Marijuana Control Act, Title 4, Chapter 13 of the Delaware Code, enacted in 2023. The Office of the Marijuana Commissioner (OMC) regulates it within the Department of Safety and Homeland Security. Its regulations were finalized in September 2024.
The medical program dates to 2011 under Title 16, Chapter 49A. House Bill 425 moved the medical program from the Division of Public Health to the OMC. Medical establishments could convert to adult-use licenses for the launch.
House Bill 373, signed July 23, 2026, creates a regulated channel for hemp-derived THC beverages. Most provisions take effect October 21, 2026, with the per-container tax starting February 1, 2027.
Package stores with authorization and licensed retail marijuana stores may sell these drinks. Single-serving containers are capped at 10 milligrams of THC. Packaging and ads designed to appeal to children are prohibited. The Commissioner’s advertising authority now expressly covers infused beverages.
The same law adds a consumer protection section, effective October 21, 2026. It treats violations of the chapter as unlawful practices under Delaware’s consumer fraud statute.
Congress redefined hemp in Public Law 119-37, signed November 12, 2025, with a 0.4 milligram total THC cap per container. A September 2026 funding law delayed most of those limits to December 11, 2026. HB 373 says Delaware’s beverage sales may sunset if federal hemp law changes. Beverage brands should watch both tracks closely.
The OMC writes and enforces the advertising rules. The statute directs the Commissioner to restrict advertising, marketing, and signage. That includes a ban on mass-market campaigns with a high likelihood of reaching minors.
The detailed rules sit in Section 10.0 of 4 Del. Admin. Code 5001. Enforcement can start from complaints, inspections, or the Commissioner’s review of public ads. The OMC can demand your audience data, and an ad without adequate data must come down.
Municipalities and counties can regulate the time, place, manner, and number of marijuana establishments. Local sign ordinances can also be stricter than state limits.
Public-facing ads must include four statements set out in Section 10.1.2. In summary, they cover:
Use the exact wording in the regulation, not a paraphrase. Build these statements into templates for every format.
Delaware cannabis marketing regulations ban ads that:
Branding, meaning your name, logo, and design, is not treated as advertising. It still cannot use the youth-appeal elements listed above.
Retail stores may never give away marijuana or marijuana products for free. Discounts are allowed, but not when tied to sales of non-marijuana products. Promotions for valid medical card holders are exempt from these promotion limits.
Delaware dispensary advertising regulations set an 85 percent adult audience floor. It applies to television, radio, internet, mobile apps, social media, other electronic communication, event sponsorships, and print. The test is based on reliable, current audience composition data.
Broadcast is even tighter. Radio, television, other broadcast media, mass transit, and internet or app pop-ups are banned. The exceptions are subscription broadcast media whose subscribers are 21 and older, or ads adults 21 and older requested.
Outdoor advertising is mostly off the table. Ads cannot be placed on the side of a building or in other publicly visible spots, including billboards and freestanding signboards. Exterior identification signage is allowed within the size and leaf limits. Paid or unpaid in-person solicitation is also banned.
Events need event-specific audience data. A sponsorship at Dover Motor Speedway reaches a mixed-age crowd, so an 85 percent adult audience will be hard to prove.
Delaware cannabis digital marketing follows the same 85 percent test as other media.

Section 14.0 of the OMC regulations sets the penalty range. Fines cannot be less than $250. The maximum is 10 percent of the establishment’s estimated average gross monthly sales over the prior 12 months.
The Commissioner may also suspend or cancel a license, require corrective action, or order a recall. Starting October 21, 2026, chapter violations are also treated as unlawful consumer practices under Delaware consumer protection law.
State rules apply everywhere, but local governments regulate the time, place, and manner of operations. Check municipal sign codes before installing exterior signage.

Yes, within strict OMC rules. Most media requires an audience at least 85 percent aged 21 or older, backed by current data. Ads must carry required health and safety statements and identify the responsible business. Billboards and most publicly visible ads are banned, and broadcast is limited to narrow exceptions.
Yes. Adults 21 and older can buy cannabis from licensed retailers, and adult-use sales began August 1, 2025. Delaware also runs a medical program, now overseen by the Office of the Marijuana Commissioner. The Delaware Marijuana Control Act in Title 4, Chapter 13 governs adult use.
Websites must use a neutral age screen before visitors see content or share contact information for advertising. If the site is appropriate for qualifying patients under 21, it must offer them an alternative screen. Internet sales of retail marijuana are banned, though online pre-orders for in-store pickup are allowed with age verification.
Discounts are allowed, but free marijuana or marijuana products are banned in every circumstance. Discounts also cannot be tied to sales of non-marijuana products. Promotions for valid medical card holders are exempt from these limits. Any advertised deal must still meet the other advertising rules.
The medical program now sits with the OMC, and dispensaries often serve both medical and adult customers. Patient promotions get some flexibility under the promotion rules, and sites serving under-21 patients need a separate screen. The general content rules, including the ban on health claims, still apply to public-facing ads.
The Commissioner can fine a licensee at least $250, up to 10 percent of average gross monthly sales. Suspension, cancellation, corrective action, and recalls are also possible. An ad without adequate audience data must be removed. From October 21, 2026, violations also count as unlawful consumer practices.
Delaware cannabis advertising laws are detailed, but they are predictable once your templates, data, and gates are in place. Operators who build that system early can grow while newer competitors stall in review.
